Update as of 02/14/07

On September 15, 2006, the Settlement Center issued Percentage of Revenue payments to Eligible Class Members who own cable-side property that adjoins a corridor for which Thoroughbred Technology and Telecommunications, LLC received payment for the sale or leasing of more than three fiber conduits.

On December 6, 2004, the Settlement Center continued the payment of benefits to cable-side class members who have submitted a timely and complete Claim Form for the following Settlement Corridors.

Update as of 4/29/03

No petition for review of the October 29, 2002, decision of the United States Court of Appeals was filed with the United States Supreme Court by the deadline of February 24, 2003.  Consequently, the decision of the United States District Court for the Southern District of Indiana approving the Fiber Optic I Settlement is final.  Settlement Class Members can expect to begin receiving Benefits Notices in the coming months.

Benefit notices will be distributed first to Settlement Class Members who own land adjacent to those Settlement Corridors in which telecommunications cable has been installed.  Telecommunications cable has been installed in all or part of the following Settlement Corridors:

·             Segment  1            Atlanta, GA – Jacksonville, FL       

·             Segment  2            Atlanta, GA – Chattanooga, TN     

·             Segment  6            Detroit, MI – Toledo, OH   

·             Segment  7            Atlanta, GA – Charlotte, NC

Update as of 1/31/03

On October 29, 2002, the United States Court of Appeals affirmed the decision of the United States District Court for the Southern District of Indiana and on November 26, 2002, denied a motion for rehearing.  The deadline for filing a petition to the United States Supreme Court for review of the decision of the Court of Appeals is February 24, 2003.  Such a petition would delay the distribution of compensation to Class Members.  The length of the delay would depend on the United States Supreme Court and cannot be predicted.

If no petition to the United States Supreme Court is filed, Settlement Class Members will begin to receive Benefits Notices some time after March 26, 2003.  The Benefits Notice will include the following information: (i) the amount of linear feet a Settlement Class Member is determined to own on a Settlement Corridor; (ii) the amount of linear feet, if any, that a Settlement Class Member owns on the Cable Side of a Settlement Corridor; (iii) if a Settlement Class Member owns footage on the Cable Side of a Settlement Corridor, the amount of cash compensation the Settlement Class Member is entitled to receive when the compensation becomes due; and (iv) the number of membership interests in Class Corridor LLC a Settlement Class Member is entitled to receive when such interests are issued.

 

Update as of 4/05/02

The argument on the appeal of the Settlement Agreement took place in Chicago, Illinois, on April 3, 2002, before a panel of judges from the United States Court of Appeals.  We are awaiting a ruling from the Court.

 

Update as of 3/28/02

The Fiber Optic Fund I Settlement is still on appeal. However, a Court hearing has been scheduled for Wednesday, April 3, 2002, in the U.S. Court of Appeals for the Seventh Circuit. This hearing may determine whether or not the appeal will be dismissed.

The results of this hearing will be posted to the website.

 

Update as of 10/19/01

The following statement has been prepared by Class Counsel and posted at the request of Class Counsel:

The Fairness Hearing held on August 21, 2001, was successful and the Honorable Sarah Evans Barker of the United States District Court for the Southern District of Indiana approved the Settlement by orders entered on August 28, 2001, and September 5, 2001. Two Class Members, however, filed objections and were represented by counsel at the August 21st hearing. The Court rejected their objections, and one Class Member filed an appeal to the U.S. Court of Appeals for the Seventh Circuit. This appeal will delay the distribution of compensation to Class Members.
